Every state has criminal laws that control what can and cannot be done within that state’s boundaries. While marijuana possession and use is legal in some states, possession is not permitted in the state of Pennsylvania. Even if a person has a valid prescription for marijuana in California, said prescription does not permit a person to possess marijuana in the state of Pennsylvania. Under Pennsylvania law, it is a misdemeanor offense to possess marijuana, and whether or not a person is prosecuted is at the discretion of the prosecution attorney.
